Terms and Conditions NYC Pop-Up 2026 Giveaway

2. Eligibility

Participation is open to individuals aged 18 years or older.
Minors are excluded from participation. If the accompanying person is a minor, the winner must be their parent or legal guardian.
Participants and their accompanying person must be legally permitted to travel to and enter the United States.
Employees of NAYS, affiliated companies, participating agencies, and their immediate family members are excluded.
No purchase is necessary to enter or win.

3. Contest Period

The contest begins upon publication of the official NAYS NYC Giveaway Instagram post and ends on: Sunday, August 30, 2026 at 6:00 PM CEST.
Entries submitted after the deadline will not be considered.

4. How to Enter

To participate, entrants must:

Comment on the official NAYS NYC Giveaway Instagram post.
Tag the person they would like to take with them to New York City.
Explain why they and their +1 should join NAYS in NYC.

Only entries submitted through the official contest post will be considered. Participation is free of charge.

5. Winner Selection

This is a skill-based creative contest and not a random prize draw. Following the contest period, the NAYS team will review all eligible entries. The winner will be selected based on originality, creativity, authenticity, and overall fit with the NAYS brand. Likes or reactions received on an entry will not influence the decision.

6. Prize & Taxes

One winning participant will receive a trip to New York City for themselves and one accompanying person in connection with the NAYS NYC Pop-Up (September 17–20, 2026).

The prize includes:

Two direct economy-class flights to NYC (round-trip) departing from the nearest major airport, selected by NAYS.
One hotel room for two people for three nights.
Access for two people to the NAYS NYC Pop-Up / Opening Party.

Travel Conditions & Exclusions:

Direct Flights Only: The prize solely covers direct flights from the designated departure airport to NYC and back.
Feeder Transport: Travel to and from the departure airport is not included and must be arranged and paid for independently by the winner and their companion.
Local transport in NYC, personal expenses, meals, travel insurance, ESTA/visa fees, and any other costs are strictly excluded.
The prize is non-transferable and cannot be exchanged for cash.

Taxes: The winner is solely responsible for any personal income tax liabilities, statutory duties, or other tax obligations that may arise in connection with accepting the prize.

7. Passport, Visa, ESTA & Entry Requirements

The winner and accompanying person are solely responsible for obtaining valid travel documentation (passport, ESTA, visa). If entry is denied or documents are missing, NAYS is not obliged to provide alternative travel dates, cash compensation, or a replacement prize.

8. Winner Notification

The winner will be contacted exclusively via Direct Message from the official NAYS Instagram account (@nays_baits). The winner must respond within 48 hours. If no response is received within this timeframe, NAYS reserves the right to select an alternative winner. NAYS will never ask for payment or banking details to claim a prize.

9. Rights of Use & Content Constraints

By entering, participants grant NAYS a non-exclusive, worldwide, royalty-free right to use, reproduce, and display their submitted comment and Instagram handle for contest administration and related public coverage. In the event of winning, the participant explicitly consents to the public announcement of their Instagram handle on NAYS’s official social media channels (e.g., in an Instagram Post or Story). Submissions must not contain unlawful, offensive, or third-party rights-infringing content.

10. Limitation of Liability

NAYS is fully liable for intent and gross negligence as well as damages resulting from injury to life, body, or health. In cases of slight negligence, NAYS is only liable for breaches of essential contractual obligations (Kardinalpflichten). NAYS assumes no liability for technical failures on Instagram or third-party service interruptions. Legal recourse regarding winner selection is excluded (Der Rechtsweg ist ausgeschlossen).

11. Data Protection (GDPR / DSGVO)

Data Controller: NAYS GmbH (gdpr@naysbaits.com).
Purpose & Legal Basis: Personal data (Instagram handle, comments, contact details) is processed strictly for conducting the contest, delivering the prize, and publicly announcing the winner pursuant to Art. 6(1)(b) and (f) GDPR.
Storage Duration: Data will be deleted once the contest and travel arrangements are fully completed, subject to statutory retention periods.
Rights: Entrants have the right to access, rectification, erasure, and restriction of processing regarding their personal data, as well as the right to lodge a complaint with a supervisory authority.

12. Instagram Disclaimer

This contest is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta. Entrants fully release Instagram from any liability related to this promotion.

13. Modification & Early Termination

NAYS reserves the right to modify, suspend, or terminate the contest in whole or in part at any time without prior notice if it cannot be executed as planned for good cause (wichtiger Grund)—such as technical failures, manipulation, fraud, or legal restrictions.

14. Governing Law & Severability

This contest and these Terms & Conditions are governed exclusively by the laws of the Federal Republic of Germany. Should any individual provision be or become invalid, the validity of the remaining provisions shall remain unaffected.
